Shiny bows at Luella Spring 2010. Photo: Getty ImagesBig and small, chiffon and taffeta, hair bows of all shapes and sizes made a recurring appearance on the Spring 2010 fashion runways. Worn pinned along the sides of the hair like a middle school girl at Diane Von Furstenberg, wrapped around the head like a perfect present at Jason Wu and tied around a side ponytail at Milly, bows were a beauty headliner. Not since the 1980s have hair bows been this stylish. And the trend seems to be channeling the decade, too. Over the top and oversized (think Madonna during her Like a Virgin days), as well as smaller ones worn two and three at a time (after all, it was the decade of excess) were the most notable styles parading down the runway. Fabrics were equally extreme, with taffeta, chiffon and patent leather among the most decorative.According to the pros, to look less Material Girl and more modern-day, size and placement matter.

The Federal Trade Commission just announced their new guidelines for "Product Endorsements". These guidelines will have an immediate impact on advertisers, marketing agencies and individual endorsers like celebrities and mom bloggers. Why, because they truth must be told about what type of payment, if any was received and what product was given free to the reviewer or endorser.

The new Rules will go into effect December 1, 2009. The press release and link to the report can be found here http://www.ftc.gov/opa/2009/10/endortest.shtm . The effect on "mom bloggers" and "word of mouth agencies" will be played on during talk shows and on social networks because they are obligated to disclose their affiliation with the advertiser. Comments from Joe Chernov, VP of Communications and Marketing for Word of Mouth agency BzzAgent said that he supported the new guidelines and felt that the guidelines clearly establish what's right and what's wrong.

We currently came across these images from NY Fashion week that made us cringe. The Snuggie blanket runway Fashion Show (Oxymoron if there ever was one). Snuggie is introducing new textiles offerings that are sure to entice you to purchase if you have not already! In addition, they are now offering Snuggies for kids and dogs. Do I see this going the same way as the Crocs story?

We know that our Children through Teens apparel line does not always meet every body's fashion sense but at least we know what is cutting edge and what is not. Our new Fall line is certainly cutting edge with some designs (Boys & Girls printed T's, ruffle bottom onesies, Petti Skirts, Pillow Case dresses...) and prints that we have not scene any where. Here we go again! Well, not really with Three Peas Co but the "style-haters". This time it is with Michelle Obama and the shorts that she choose to wear during a recent visit to the Grand Canyon on a vacation visit with her daughters during August. Grand Canyon August average temperature is 83 degrees.

The shorts, pictured above, are mid thigh length and appropriate for walking/hiking in the desert.
What is the controversy with Michelle Obama's shorts?

According to the Business Week article, the Today show, "some" are calling her fashion choice inappropriate—but the article quotes only those who support the look or, in the case of Washington Post fashion writer Robin Gihven, those who are "ambivalent" about bare legs for an August hiking trip in Arizona". They could not find anybody who actual said they were upset with the length of the shorts but sited the usual suspects as commenting on this, the Examiner, Huffington Post and LaTimes blog. Do any of these ring a bell? They should! All of these same publications wrote about Noah Cyrus and her alleged Pole dancing routine at the 2009 Teen Choice Pre-party. These articles started a national debate as to the parenting merits of the Cyrus's, morality of adults in attendance and behavior of this little girl(s) Noah Cyrus and friends. There is no wonder that most creative fashion purist come from other Europe. But we here at ThreePeasCo will continue to create and pursue clothes that allow for our kids and yours to enjoy themselves and feel proud to not look like every other kid. Let's help our kids learn early on to feel comfortable in expressing who they are and to not have issues (yes, I said issues) about their appearance.
Finally, to Michelle Obama, you rocked those shorts lady. Keep dressing the way you are and let the so called non-fashion critics throw stones.

I was lucky enough to receive some hair bows and a hair clip for my eldest and the coolest crown you ever did see for my 18 month old son from Three Peas Co. (You can't see it online but I am sure you can order it from them.) The attention to detail astounded me. These are very high quality items that you can use for years to come as well as pass down to other lucky kids. Three Peas Co. is gearing up for fall and have been very busy in the process. Between sewing the new children's lines, including many new boys and girls pieces and scouting photoshoot locations we are happy to say it is almost here. Yesterday I visited a few Ojai ranches and was overwhelmed with happiness when I saw my visions coming to life.

Whith that being said, I am on to scheduling models, making sure last minute pieces are finished and getting ready for our next project, the Teen Choice Awards.

About 1 million play yards have been recalled because the side rail can fail to latch properly. A child who pushes against it could fall.
The play yards are sold under the brand names of Kolcraft, Carter's, Sesame Street, Jeep, Contours, Care Bear and Eric Carle. They're manufactured in China, Spain and Italy and distributed by Kolcraft Enterprises Inc. of Chicago.
The company has received 347 reports of play yards' sides collapsing, resulting in 21 injuries, including a concussion, as well as bumps, scrapes and bruises.
The play yards were sold online as well as by Babies R Us, Walmart, Kmart, Sears, Target and other stores around the country between January 2000 and January 2009.
The play yards were produced between December 2000 and July 2008 and sold for between $49 and $160.

We at Three Peas Co. are founded on the basis of being home with our children. For the 4th of July we would love to invite your families and friends to join ours for the pushem-pullem parade here in downtown Ventura.

***The parade itself is worth coming for, but we of course have a mission. We would like to get as many floats, wagons, bikes or any other non motorized cart and have a contest amongst you, our awesome supporters.

The contest – with your families creativity, design and build a float with best use of Three Peas Co. on it to show off our brand and style. The family that best displays imagination and our brand will win a prize.

This will be a super fun day, immediately following there is the street fair with games food and free entertainment.

The parade official start time is 10:30. Our event will begin at 9:45. We will have our float and kids in tow and meet any who want to take part around Cemetery Park. We will be filming and taking many pictures so please come in 4th of July style.

Now, I have 3 girls as you all know. Isn't it surprising if I told you that they have never owned a Tutu??! I know, get with the program, Mom!! When I was a young girl, I loved to dance and twirl in Tutu's, it's just part of being a girl. And, I have been looking for one for my daughter for some time now, but none really caught my eye as THE Tutu! When I came across Three Peas Co., I saw their styles and I was hooked.Three Peas Co was founded by 2 best friends of 25+ years, who are SAHM in California. Antoinette Augustina Newhouse (one of the Mom's) is the designer behind the label. Her adorable and fashionable creations for Three Peas Co. spark the carefree, playful side of being a kid. And make it a lot more stylish as well.You'd think my daughter had actually been crowned princess when Antionette's Pettiskirt came to our door. It is a fuchsia Pettiskirt which is very full, Antoinette is not stingy on the fabric! It has a slight shimmer to it, and for a touch a sass - a pink and black Leopard print bow is at the front. The stitching on the skirt is remarkable, definitely made to last. And the Pettiskirt will last for all 3 girls, as the size for this one is from 2T to size 12. This Pettiskirt will see many years of dancing, twirling and laughing. The ability to make it smaller or bigger allowed me to try it on the twins. Only for a picture though, my oldest princess claimed it as all hers. Isabelle plays dress up with it in the house. Yet, worn with black leggings, this Tutu is also worn outside of the house. And you can imagine the 'Ahhh's' she gets strutting around in it! {So Cute!}Antoinette sent the twins their own Onesies, black in color with the same Leopard print trim around the neck. It also has a flowered print skirted waist. The fabric on the waist did come with quite a few loose threads, which I didn't want the girls to get hold of. So, I snipped the off myself. Antoinette also sent 2 adorable flowered headbands, light green with a pink flower. But, sadly - the girls would not keep them on for the picture. I see these onesies great by themselves or paired with a Pettiskit -either way they are adorable, and sure do make ordinary onesies look very plain in comparison.Three Peas Co. is assisting in the grooming of my 3 peas into bonafide royalty! And, I love seeing the smiles and laughter when Isabelle plays in her Tutu (just as I had when I was younger, dancing in my Tutu) , I have one question: Is there a Pettiskirt to fit myself, Antionette?Little boys aren't left out at Three Peas Co. IN THE CUTTHROAT world of business, companies are always looking for ways to increase their profits. They outsource to Bangalore. They endlessly tweak their "brands." Some even try to shed their least desirable customers.
Now, a growing number of consultants and corporate leaders swear by a new strategy to boost the bottom line, one that departs from the standard bag of tricks: put more women in charge.
Several studies have linked greater gender diversity in senior posts with financial success. European firms with the highest proportion of women in power saw their stock value climb by 64 percent over two years, compared with an average of 47 percent, according to a 2007 study by the consulting firm McKinsey and Company. Measured as a percent of revenues, profits at Fortune 500 firms that most aggressively promoted women were 34 percent higher than industry medians, a 2001 Pepperdine University study showed. And, just recently, a French business professor found that the share prices of companies with more female managers declined less than average on the French stock market in 2008.
This mounting body of evidence represents an important twist in the debate over women in business. For decades, women's advancement has been seen as an issue of fairness and equality. Now some researchers are saying it should also be seen in another way: as a smart way to make money.
"The business case is so strong," says Alison Maitland, senior visiting fellow at Cass Business School in London, and coauthor of the 2008 book "Why Women Mean Business." "We need more women in senior management."
The numbers are certainly striking, but their meaning is not yet fully understood. Correlation does not equal causation: While the link between higher levels of female leadership and profits is fairly well-established, it's less clear that women are directly responsible for the success. Rather, companies of a particular kind - forward-thinking, adaptable - may both turn higher profits and promote more women. And some of the data on women's influence are mixed. One recent study, for example, found that the presence of senior women just below the CEO led to higher profits - but the effect of female CEOs was neutral or slightly negative.
And if the high-level women do directly cause better performance, it is not entirely clear why. One possibility is that women enjoy an edge in understanding the consumer market: by some estimates they make 80 percent of consumer purchases. Another theory is that gender diversity stimulates more vigorous discussions, resulting in smarter decisions. More controversially, women may on average exhibit a different, and fruitful, leadership style.
Some analysts even suggest that women might have been able to temper the excesses that led to the current financial crisis. The culprits, one can't help but notice, were overwhelmingly male. More women at the table, some speculate, might have served as a prudent counterweight to reckless, testosterone-addled men. In fact, Iceland has dispatched a team composed largely of women to clean up after its collapse.
"There's evidence that women tend to be more risk-averse than men," says Daniel Ferreira, who teaches at the London School of Economics. Based on his own research, he says, "Women on boards would have been more vigilant and more worried about what the executives were doing. I suspect that it would have attenuated the crisis we are living now."
It can be easy to forget the momentous change in the position of women that has occurred, at least in Western societies, over the course of a few generations. Young women today approach life with ambitions and expectations that their great-grandmothers would have scarcely believed. Girls surpass boys academically in elementary and high school, and the majority of American college graduates are women.
Yet the corridors of corporate power are still dominated by men. Last year, women at Fortune 500 companies held only 15 percent of board director positions, 16 percent of corporate officer positions, and 6 percent of top earner positions, according to a study by Catalyst, a nonprofit dedicated to expanding opportunities for women in business. The figures are even lower in most of Asia and Europe.
Going back at least to Betty Friedan's 1963 book "The Feminine Mystique," feminists have pushed for women to enter the workforce, to find a source of meaning, income, and independence outside the home. The dissatisfied housewives of Friedan's book are much less common now, and women have poured into all sectors of the economy, moving far beyond the secretary's office. Yet they still encounter the infamous "glass ceilings" and "sticky floors." The reasons are multiple and mutually reinforcing: tenacious associations between leadership and masculinity; women's own priorities and obligations as mothers, which depend in turn on their spouses' parental contributions; and a variety of subtle cultural barriers.
As women have slowly penetrated the upper echelons, though, scholars have started to study the impact of their presence. In 2001, the late Roy Adler, a professor at Pepperdine University, found that companies that promoted more women also did better financially. He and his colleagues examined data provided by more than 200 Fortune 500 companies about the gender makeup of their senior management and board members from 1980 to 1998. They discovered that the 25 best firms for women outperformed the industry medians on three measures. Calculated as a percent of revenue, their profits were 34 percent higher; as a percent of assets, they were 18 percent higher; and as a percent of stockholders' equity, they were 69 percent higher. The results were published in the Harvard Business Review.
In 2007, Catalyst published a study looking at the number of female board members at Fortune 500 companies, using data from 2001 to 2004. The researchers divided the companies into four groups - the top quartile had the most women on boards, the bottom quartile the least - and compared their profitability on several metrics. In return on equity, the top quartile yielded 13.9 percent, compared with 9.1 for the bottom; for return on sales, the top quartile achieved 13.7 percent, versus 9.7; for return on invested capital, the top quartile reached 7.7 percent, as opposed to 4.7.
"If you take a company in 2009, and it has no women on its board, you've got a troubled company," says Harvey Wagner, a business professor at the University of North Carolina who helped conduct the study.
A few researchers have begun to tease out the dynamics at work. One recent study determined that women in senior management had an especially positive impact on firms involved in research and development. Based on data from 1,500 American companies, from 1992 to 2006, the study used an econometric analysis to try to answer the chicken-and-egg question of whether better firms promote women or women in power make better firms. The authors - Cristian Dezso, a professor at the University of Maryland, and David Gaddis Ross, a professor at Columbia University - reported some evidence of the former, but stronger indications that women leaders exert a beneficial influence. "It's consistent with this theory that women manage in a participatory way, a democratic way," says Dezso, a style that is thought to foster teamwork and creativity.
Not all of the evidence, however, points to the unalloyed advantages of female leadership. These findings applied to senior positions "just below" the CEO, but the study found no positive effect of having a female CEO. They also identified the benefit only in companies that spend a significant portion of their budgets on research and development.
Daniel Ferreira's recent study, conducted with Renee Adams at the University of Queensland in Australia, examined the influence of gender on corporate boards, and likewise arrived at mixed conclusions. The presence of women appeared to affect the dynamics of boards, specifically by making them more vigilant. If a company was otherwise poorly governed, these boards seemed to enhance profits. But if the company was already governed well, the tougher, more gender-diverse boards actually appeared to have a counterproductive effect, diminishing profits.
"Women tend to be tougher as monitors," says Ferreira. "Their leadership style seems to be different. This is not necessarily a good thing in all circumstances."
Scholars have called for further studies to explore these questions in greater depth and nuance. Where women appear to positively influence performance, is this effect due to greater gender diversity, or to superior female management? In other words, is a 50-50 balance optimal, or is it the more women the better? (This has been essentially impossible to study because so few firms are female-dominated.) Another important question is what distinguishes firms that retain women from those who don't - is it a matter of instituting certain policies, or more nebulous cultural elements? And are female-friendly policies - in particular, those designed to enhance work-life balance - detrimental to profits, or might they instead yield monetary rewards? Given the mixed evidence - and the need for much more research - some caution against taking the case for female leadership too far. Companies should not expect that simply putting more women in corner offices or on boards will automatically improve performance, Ferreira believes. He and others are wary of quotas, which have significant support in parts of Europe. Norway even has a law requiring that women constitute 40 percent of board members.
Still, a number of corporate leaders maintain that senior women confer a competitive advantage. CEOs such as Carlos Ghosn of Nissan and Renault, Andrew Gould of Schlumberger, and Michel Landel of Sodexho have spoken of the promotion of women as a key to business growth, and their companies have all introduced policies, including numerical targets, to encourage it. Baxter International Inc., citing research on the financial benefits, recently set and reached a target of 50 percent women in management and executive positions in its Asia Pacific branches. Last October, a group of male executives who participate in a British mentoring program published a letter to the editor in The Telegraph: "We are convinced it is essential to accelerate the progress of women into senior positions, given the UK's need to deploy the best talent available. This need is greater than ever in the current economic climate."
According to much of the scholarly literature, women struggle with a number of disadvantages, such as discomfort with promoting themselves. They are much more likely to report lacking access to the informal networks that spread crucial information and advice. Disproportionately responsible for child care, they require more flexibility. As a result, many exceptional female employees languish in middle management and eventually leave in frustration.
This is the most basic reason many analysts identify for the correlation between gender diversity and corporate performance. Organizations that are sensitive to these issues, and are therefore closer to being genuine meritocracies, tend to thrive.
"Those organizations produce more women leaders and better results," says Herminia Ibarra, a professor at INSEAD, an international business school. "They're picking the best and the brightest, and letting them bloom."

When Does Mothering Become Smothering? Part 1

At the end of a talk to a group of parents by clinical psychologist Kathleen Nadeau, Ph.D., a concerned parent asked for advice about her chronically forgetful son. He regularly left the books he needed for homework at school causing him to fall behind. Nothing the mother tried had helped. Dr. Nadeau an expert on family dynamics and ADHD, suggested that the mother obtain a second set of schoolbooks to keep at home. The mother, not wanting to be overprotective, said, "But wouldn't I be enabling him?""Yes," Nadeau replied. "You'd be enabling him to do his homework!" Although Dr. Nadeau's advice was given to a parent whose child has Attention Deficit Hyperactivity Disorder (ADHD), the parent's question underscores a major concern of parents everywhere: When does responsible and appropriate parental involvement cross the line and become overprotective? This is a special worry for parents of only children, who have long been accused of excessive child coddling. But is it fair to single out parents who have one child? The emergence of the fashionable term "helicopter parents," which refers to parents who hover over their children, suggests otherwise. In all likelihood, the term would never have evolved, much less taken root, were overprotection solely the domain of one parental subgroup.
The popularity of A Nation of Wimps: The High Cost of Invasive Parenting by Hara Estroff Marano, a Psychology Today editor-at-large and blogger, further indicates that over-parenting has affected an entire generation. One needs only to read the chapter titles in Nation of Wimps such as "We're All Jewish Mothers Now," "Cheating Childhood," and "From Scrutiny to Fragility," to understand what a dim view A Nation of Wimps' author takes of what she considers coddling children. Marano's concern is broadly shared. Many experts also argue the dangers of helicoptering, such as children rendered incapable of making their own decisions or dealing with disappointment as adults.
Parents who take a different route are harshly criticized as well. Lenore Skenazy, author of Free-Range Kids: Giving Our Children the Freedom We Had Without Going Nuts with Worry was labeled "America's Worst Mom" after she published a story in the New York Sun explaining how she trusted her nine-year-old son enough to let him go solo on the subway (with a map, metro card, quarters for the phone, and 20 dollars) for the first time. It took only a day for a representative from the Today Show to call and ask, incredulously, if it were true she had "abandoned" her son in midtown New York. Skenazy and her son appeared on the show where she was introduced by Ann Curry asking rhetorically whether her guest was "an enlightened mom or a really bad one?" This was followed by a face-to-face with a "family expert" who was there to, Skenazy says, "teach me a lesson."
Her son made it safely home from New York's midtown and was proud of himself, his confidence boosted. Hovering, coddling, overprotective, controlling parents will do most anything to see their children succeed. Skenazy's advice to parents is, "relax and give them some space. Children learn a lot from failure." In fact, she says, failing is how you get to success: You get lost and then you find your way again. "That probably happened to you sometime in your childhood and now it's a proud memory. It's when you realized you could do something by yourself. Those are childhood's magic words: ‘I did it myself!' Not, ‘Mommy helped me do it!'"New York Times columnist Lisa Belkin admits to her own "helicoptering tendencies" and recognizes the danger of protecting children from the reasonable consequences of their choices and actions. Nevertheless, in a piece titled, In Defense of Helicopter Parents, Belkin points out children can benefit from a reasonable dose of parental scrutiny. Her article notes that today the complex and sometimes fraught process of growing up has only been exacerbated by the demands put on entire families by the current economic crisis. These days, for example, the choice of which college a middle class child attends demands increasingly intense parental involvement. I spoke with Lenore Skenazy to get her side of the issue. She noted "that the same deep desire to preserve our young from death and dismemberment is what we now bring to the SATs." Parents are intent on building bulging resumes for their offspring. While Skenazy readily admits signing her own 13-year-old up for test prep, she also admits letting him quit "the guitar lessons and robotics lessons and the football lessons that might have made him ‘college catnip.'" Researching her book made her realize that free time and poking around are as important as taking an extra class, the choosing of which is usually overseen by helicopter parents. "In fact, why don't we just think of ‘playing' as the new, hot, extracurricular activity, and put it down on the college application. That way, everyone wins!" she suggests. "No, really, the point is that there's no way to make a ‘perfect' kid and no reason to try," she says. "The best we can do is try to give them the ultimate gift: resourcefulness. And the way they get that is by doing some of the heavy-ish lifting on their own." A reappraisal is underway and many are defending helicopter parents much to Marano and Skenazy's dismay. Clearly, people don't agree on the best approach. At what point does mothering (or fathering) become smothering?Three Peas Co. Abbigaile loves to twirl, and spin and wear frilly stuff, but usually within minutes she's trying to dig, or pick up a frog, or play in some mud or trees.When our Pettiskirt and tank (and matching bow!) came in the mail from THREE PEAS CO. Abbie literally shrieked with excitement, "Look Mommy!!! It's mine dress?!?!?!""On my dress Mommy? On my dress!"I couldn't get it out of the box, and on her quick enough! As soon as I tied the back of her skirt, she started twirling."Look Mommy, I daaaan sin!""I so priddy Mommy.. Mommy, you love my dress? An my flow-Er? An my priddy bow?""I beautiful mommy! I hap-eeeeeee!" *melt*Love at first sight is not even the phrase to describe how deeply she fell in love with this pettiskirt. It's so full and light and fluffy! It looks so cute, and EVERYONE, EVERYWHERE we go comments about this outfit.Sure enough about an hour into her twirling and spinning and mini photo shoot, Abbie wanted to play. She hopped on her bike, and started pedaling to our neighbor's house."I go show CT's mommy my new dress. Ok Mommy? Come on Mommy!"Every time she wears this outfit, you can tell she feels like a million bucks! She just needs to show everyone, and anyone, and tell them all about it!The customer service at THREE PEAS CO. is unbeatable. The quality in their products are amazing, and all of the items themselves are just so sweet! The bright, welcoming playground at a fast food restaurant is a magnet for kids and a draw for parents. But behind the colorful façade of the child-friendly wonderland lurks a potential danger zone. Momlogic has learned a Burger King franchise in Southern California has reached a $20 million, out-of-court settlement with the family of a child who was severely injured in one of their playgrounds.

In August, 2005, then 8-year-old Jacob Buckett, his father and younger sister went to lunch at a Burger King in Temecula, Calif. In a matter of minutes, Jacob climbed up the horizontal support poles of the play structure and suddenly lost his grip. He came crashing down, cracking his head on the tile floor. His father Kevin recalls that the horrific noise sounded "as if you took a bowling ball and dropped it about ten feet on the floor." Jacob suffered a traumatic brain injury that left him with permanent, lifelong impairments.
The Buckett family claims the franchise owner and its parent company Burger King knew the jungle gym was dangerous but never bothered to fix the problem. They argued the playground had significant safety risks such as a lack of "no-climb netting" around the structural poles and not enough floor padding. They say the restaurant owner knew about the potential hazards because of prior accidents.
In addition, they said the restaurant's franchise owner, The Breckenridge Group, failed to safeguard the poles that were used by children daily as monkey bars. The restaurant never posted warning signs and refused to retrofit the structure. Even after Jacob's near-death experience, the playground remained unchanged... three years later.Jacob's parents sued the franchise owner and parent company, arguing Burger King was liable under the principles of "ostensible agency." That means parents reasonably relied on the franchisor and its specific restaurant branding to ensure a safe product. The family's attorney, Christopher Aitken, said, "Most families, like the Bucketts, do not come into fast food restaurants with any playground safety expertise. They rely on the restaurant, through their branding and safety programs, to ensure a safe product for their children to play," Burger King ultimately settled with the Bucketts for $20 million.
These commercial structures, known as "soft-contained playgrounds," like those at Burger King and other fast food restaurants, are not necessarily more dangerous than any public playground. According to the Center for Disease Control and Prevention, ERs treat more than 200,000 children every year for playground-related injuries. Today, Jacob Buckett is 12 years old, with the maturity level of a child half his age. The brain damage left him with partial paralysis and severe emotional and cognitive problems. He cannot wipe himself after using the bathroom. He gets frustrated easily and often has temper tantrums. He lacks impulse control, which could lead to dangerous behavior. "Before the accident, he would talk all the time about getting married and having children," said his mother, Julie, who now wonders, "Will he ever have the mental ability to even take care of himself?"
Jacob's condition has devastated his family -- especially his father, Kevin, who witnessed the accident. "There are times when it's just so overwhelming, the weight is just too much to bear." The family hopes shedding light on this issue will put the fast food restaurant industry on notice. "We are pleased to see that after the Buckett incident, the fast food chain finally started implementing an inspection system for such playgrounds to make sure they are safe for families," said Aitken.
The multi-million dollar settlement will pay for Jacob's enormous medical bills, 24-hour attendant care and ongoing rehabilitation therapies.
Major fast food chains like Burger King, McDonald's and Chuck E. Cheese's all have playgrounds.
The enticing play zones lure children while restaurants rake in billions of dollars in additional profit. But children could pay the ultimate price if they're not careful playing at some of these playgrounds.
Fast food restaurants argue they're not responsible for safety because they hire independent companies to build the play structures, despite spending big money to market and brand the equipment. In a written statement to momlogic, Burger King spokeswoman Denise Wilson wrote: "Burger King Corp. has stringent playground safety and cleanliness procedures for all its BURGER KING® restaurants. An independent, third party company annually inspects playgrounds at both company and franchised restaurants."
The Bucketts' attorney argued Burger King provided no oversight or inspections to ensure its franchisee restaurants followed playground safety standards. "The fast food chains certainly stand to profit for the rise of sales that such playgrounds provide. It is this lack of third party safety inspections, or oversight, that can cause major injuries such that befell young Jacob Buckett," said Aitken.
Burger King insists its restaurants complied with the national standards set by the ASTM (American Society for Testing and Materials) for soft-contained playgrounds and use "only approved playground manufacturers can provide equipment and repairs to BURGER KING® restaurants."
In addition, the fast food giant blamed Jacob's father for not properly supervising his child on the playground. The Bucketts' attorney proved his point with a video surveillance tape that showed children misusing the playground on a regular basis.
Each restaurant chain is responsible for self-policing its playground safety. The Consumer Product Safety Commission has a list of set guidelines and regulations, but there isn't enough staff to enforce the rules.
"The government doesn't seem to pay as much attention to children as they do adults," said Donna J. Thompson, Ph.D., Executive Director for the National Program for Playground Safety. "If something is going to kill or badly injure a child, the inspector should tell the owner and they should shut the place down until it's fixed." A restaurant's franchise owner is the one responsible for hiring an outside inspector to periodically check the equipment.

The CPSC has taken action against fast food restaurants that violate safety codes. In 1999, the agency fined McDonald's $4 million in an effort to improve reporting and the structural integrity of its soft playgrounds. "CPSC is empowered to act when there's a violation of a voluntary standard. The agency has the ability to investigate when there is an incident brought to our attention," said CPSC spokesman Scott Wolfson. But in the case of Jacob Buckett, the restaurant did not have an inspection system to detect safety issues and any effort to upgrade the playground fell through the cracks.
The playgrounds at fast food restaurants are often as much as a draw for kids as the french fries and cheeseburgers.
While the padded structures may seem like the perfect place to let your child run wild, these parks can pose a serious risk of injury and even death. Parents may assume these soft-contained playlands are safe and that the restaurant assumes responsibility if a child is hurt. But this is not always the case.
Bottom line: don't expect anyone to be watching your kids. "If there are signs indicating the restaurant is not responsible for injuries, then it's up to the adults to supervise the kids," said Donna J. Thompson, Ph.D., the Executive Director for the National Program for Playground Safety. "A lack of supervision results in 40% of playground injuries, so supervision is very important."
Thompson offers these safety tips when taking your child to a playground:- Make sure children are on age-appropriate equipment. - Be sure there's plenty of soft surfacing under and around the structure. - Only allow the permitted number of children to play at the same time. - Check to see that the equipment is tight against the wall to prevent strangulation. - And lastly, be sure to keep a close eye on your children at all times.

What You Need:
Scissors
Socks
Sewing machine
Batting
Black felt
Black buttons

Instructions:


1. Cut lollipop-shape horns, oval ears, and eyelid shapes from the matching sock. (Our partner sock had stripes on the cuff, which we incorporated into the eyelids for flirty lashes.)

2. Stuff the horns with batting; stitch closed and cover the tips with black felt. Sew the horns and ears in place.

3. Use the eyelid sock pieces, white felt circles, and black buttons to create the eyes.

One children’s product company has vowed to become “outlaws with a conscience” and not let the CPSIA affect its business. Michael Newhouse of Three Peas Company, which carries a line of children’s apparel combining urban chic with today’s modern child, says, “We know our products are safe and will continue to forge on developing high quality boutique clothing with a ton of style.”
Three Peas Company started in January 2008 as two moms making hairbows for their daughters, because they did not like the product offerings that they were finding at the mass merchants, mall stores and boutiques. As their children were seen wearing the bows, the mothers started to received compliments and inquiries as to where they purchased the bows. These questions eventually lead to the start of Three Peas Co.
With an overwhelming demand and time constraints, one of the moms left the company, and Antoinette Newhouse continued to build the company with the assistance of her husband, Michael. The official launch for Three Peas Co. was in June 2008, and the line quickly grew form Hairbows to Onesies, Tutus, T-shirts and now includes a growing boys line.
“Three Peas Co is dedicated to our children and the children, grandchildren, friends children etc around the world that we have been privileged to provide clothes that bring a smile,” Michael Newhouse says. “We in no way would support vendors that could have potential harmful lead, chemicals or dangers with their clothes. We only order high quality material that we would use for our children. We support the founding principles of CPSIA to protect our kids, but the fundamentals of implementation are critically fouled.”

CPSC Grants One Year Stay of Testing and Certification Requirements for Certain Products
WASHINGTON, D.C. - The U.S. Consumer Product Safety Commission voted unanimously (2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.
Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.
The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.
The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.
The stay does not apply to:
Four requirements for third-party testing and certification of certain children’s products subject to:
The ban on lead in paint and other surface coatings effective for products made after December 21, 2008;
The standards for full-size and non full-size cribs and pacifiers effective for products made after January 20, 2009;
The ban on small parts effective for products made after February 15, 2009; and
The limits on lead content of metal components of children’s jewelry effective for products made after March 23, 2009.
Certification requirements applicable to ATV’s manufactured after April 13, 2009.
Pre-CPSIA testing and certification requirements, including for: automatic residential garage door openers, bike helmets, candles with metal core wicks, lawnmowers, lighters, mattresses, and swimming pool slides; and
Pool drain cover requirements of the Virginia Graeme Baker Pool & Spa Safety Act.
The stay of enforcement provides some temporary, limited relief to the crafters, children’s garment manufacturers and toy makers who had been subject to the testing and certification required under the CPSIA. These businesses will not need to issue certificates based on testing of their products until additional decisions are issued by the Commission. However, all businesses, including, but not limited to, handmade toy and apparel makers, crafters and home-based small businesses, must still be sure that their products conform to all safety standards and similar requirements, including the lead and phthalates provisions of the CPSIA.
Handmade garment makers are cautioned to know whether the zippers, buttons and other fasteners they are using contain lead. Likewise, handmade toy manufacturers need to know whether their products, if using plastic or soft flexible vinyl, contain phthalates.
The stay of enforcement on testing and certification does not address thrift and second hand stores and small retailers because they are not required to test and certify products under the CPSIA. The products they sell, including those in inventory on February 10, 2009, must not contain more than 600 ppm lead in any accessible part. The Commission is aware that it is difficult to know whether a product meets the lead standard without testing and has issued guidance for these companies that can be found on our web site.
The Commission trusts that State Attorneys General will respect the Commission's judgment that it is necessary to stay certain testing and certification requirements and will focus their own enforcement efforts on other provisions of the law, e.g. the sale of recalled products.

We interrupt the usually cheery tone of this blog with a serious topic. You're probably already well aware of the issues connected with the CPSIA, but nevertheless it is time for me to add my squeak to the growing roar of protest. I'm joining Sarah Jane and a host of other bloggers who are posting about this today. Please take the time to educate yourself on this and seriously consider the consequences if something isn't done to amend it.

When congress passed the CPSIA (the Consumer Product Safety Inspection Act) in August 2008, they were intending to protect companies from selling harmful products. All products intended for children under 12 years old must go through thorough and stringent testing. The CPSIA bans lead and phthalates in children’s products, mandates third party testing and certification, and requires manufacturers of all goods for children under the age of 12 to permanently label each item with a date and batch number.
Most people know someone who will be affected because most people know people who have children, will buy something for a child within their lifetime, or have children themselves. Most small businesses and crafters who sell children’s products care about this. They will be put out of business by this law due to the prohibitive testing costs. Their products might be safe, but they can’t afford to “prove” it. Many parents care about this, their choices for their children could be significantly limited if the mid-size, small, and micro manufacturers all go out of business due to this.
Who should be concerned?
To the Parents of Young Students:Due to the new law, expect to see the cost of school supplies sky rocket. While those paper clips weren’t originally intended for your student to use, they will need to be tested now that your 11-year-old needs them for his school project. This law applies to any and all school supplies (textbooks, pencils, crayons, paper, etc.) being used by children under 12.
To the Avid Reader:Due to the new law, all children’s books will be pulled from library and school shelves, as there is no exemption for them. That’s okay though, there’s always television. It won’t even be the one-of-a-kind blanket you were hoping for. Items are destroyed in the testing process making one-of-a-kind items virtually impossible. So that gorgeous hand-knit hat you bought your child this past winter won’t be available next winter.To the Environmentalist:Due to the new law, all items in non-compliance will now be dumped into our already overflowing landfills. Imagine not just products from the small business owners, but the Big Box Stores as well. You can’t sell it so you must toss it. Or be potentially sued for selling it. You can’t even give them away. If you are caught, it is still a violation.
To the Second-Hand Shopper:Due to the new law, you will now need to spend $20 for that brand new pair of jeans for your 2-year old, rather than shop at the Goodwill for second hand. Many resale shops are eliminating children’s items all together to avoid future lawsuits.To the Entrepreneur:Due to this new law, you will be forced to adhere to strict testing of your unique products or discontinue to make and/or sell them. Small businesses will be likely to be unable to afford the cost of testing and be forced to close up shop. Due to the current economic state, you’ll have to hope for the best when it comes to finding a new job in Corporate America.
To the Antique Toy Collector:Due to the new law, you’d better start buying now because it’s all going to private collection and will no longer be available to purchase. “Because the new rules apply retroactively, toys and clothes already on the shelf will have to be thrown out if they aren’t certified as safe.” http://online.wsj.com/article/SB123189645948879745.htmlTo the American Economy:Already struggling under an economy that hasn’t been this weak in decades, the American economy will be hit harder with the inevitable loss of jobs and revenues from suppliers, small businesses and consumers. To the Global Economy:Due to this new law, many foreign manufacturers have already pulled out of the US market. You can imagine the impact of this on their businesses.

Don’t throw yourself under the (CPSIA) bus

By now, those of you following on twitter or here in the forum may have read the letter that the most strident legislative backers of CPSIA namely Waxman, Rush, Rockefeller and Pryor, sent to Nancy Nord of the CPSC. Many have taken this letter as a good sign because it’d mean that the law’s primary proponents have publicly acknowledged there are grave issues with the law. Within our own community, the letter is seen positively because it specifically requests a “small company” exemption. Other than that they faked you with a classic bait and switch -a bone they’re thrown to get you to shut up- hinging all your hopes on a possible exemption would be a grave strategic error. Unknowingly, you will be throwing yourself under the bus. Many of us suspect that the idea of a small company exemption is a strategy to placate the masses. They are hoping you will rest easy and stop annoying congressmen and senators with phone calls and letters or continuing to lobby the press for attention. Fewer of you will be going to the media with your concerns and the negative news stories will dry up if you think there’s a fix in the works. This is the last thing that should happen. Do not rest easy.

Another great informational on contacting your reps that I just found on twitter.

This Blog today is for all the wonderful business owners I have met on Twitter and other online networks that have shared their stories and frustration on how the CPSIA (Consumer Product Safety Improvement Act) could ruin or put them out of business come February 10 2009.
I wanted to put together a list of all the Senate member's phone numbers and websites on the Commerce, Science & Transportation Committee first and then I will post another Blog with all the Representative members on the Commerce Community. From the sources I have talked to in Washington, I believe the most effective point of attack at this point is to contact all the Democrats on these committees first and try to get a least one of them that would be willing to take up our cause, because they are the majority and their Chairman (Representative Henry Waxman (CA) and Senator John D. Rockefeller IV (WV) ) decide what will be brought up for discussion at meetings. From talking to a lady at the minority Senate Commerce Committee Office, she said that there is not a lot of interest from the Democrats on the Senate Committee to bring up the CPSIA. We need to make it clear, that they need to be interested! Their names will be hyperlinked to their website, if you need further information. Please contact them by phone if you can at least once a week. This is a fight that we must not give up.
*If you live in the state where there is a Democrat on this Committee, I ask you to get everyone you know that lives in the state to call too. I would even further suggest to contact your local media and newspapers (write to the editor) and start putting pressure on your Senator by stating how this could ruin your business and many other businesses in the state and how they are choosing not to do anything about it! A uterus is not a children's toy -- even if we're talking about a plush toy uterus.
The I Heart Guts company, the makers of all sorts of organ-shaped novelty items, is recalling its plush uterus due to the fact that the toy's ovaries represent a choking hazard. According to the company's web site:
In an effort to ensure our plush products exceed federal and international safety standards, we learned the 2008 Plush Uterus has failed a pull test. The ovaries may detach when pulled, becoming a potential small part choking hazard for young children. No one has been harmed.
Although our website and sewn-on label state that the uterus is not for children aged 0-3, we have instituted a voluntary safety recall for the uterus plush. We have filed a safety recall notice with the U.S. Consumer Product and Safety Commission (CPSC). If the plush uterus is being used by a young child, please remove it immediately. If you gave the uterus as a gift, please forward this email to the recipient(s).
And if you're wondering if there's a male counterpart to the stuffed uterus, I checked the website. It's not there. But let's just assume it's not child save. (via Weird Universe/Consumerist)

So which items do you think should be out of CSPIA sweep?

In preparing all of the well needed research for this huge CSPIA catastrophe, I have discovered some sick humor as to what needs to be added to the act, repeat sick humor / sarcasm, not reality as you all know I am very anti CSPIA and not because children are not important... but because this act does not protect our children it promotes monopolies like Mattel to take over our kids toys and to never be able to have another sock monkey:(

So on that note, I found my own children licking the coffee table yesterday. They had spilled their chips and wanted to clean them up before I got back. Pretty intelligent for my 1.5 and 3 year old I thought.

With that though since the CSPIA rampage has entered my life, I figured what products do children not come in contact with?

CPSC/CPSIA Lets get Waxman to call a meeting

CPSIA, 46,000 small businesses hurt- and, did I mention you should call Waxman?
Keep up the pressure on Waxman. Call his CPSIA dedicated voicemail, and tell him you know that he can call a Committee meeting and issue some technical amendments and fix things a lot sooner and with more staying power than the Commission can. Tell him you don't appreciate him using Nancy Nord as a scapegoat for his poorly written bill. Remind him that books often have staples or plastic protective covers for their dustjackets, and 12 year olds do not typically suck on their bicycle tires. Here's the number: 202-225-2927I don't know if this would work, but you can't email him if you're not a consituent. So email your own reps and include an email to Waxman. Last Friday,
I wrote about how the testing requirements of the Consumer Product Safety Improvement Act (CPSIA) threaten to drive out of business tens of thousands of small makers of children's products; the law also menaces thrift shops with legal liability if they deal in children's secondhand goods, whether or not those goods put any child at real risk.
Just as the article went to press came a new development: The law's prime sponsors, Reps. Henry Waxman, D-Calif., and Bobby Rush, D-Ill., joined by Sens. Mark Pryor, D-Ark., and John D. Rockefeller IV, D-W.Va.,
sent a letter to Consumer Product Safety Commission (CPSC) Chairman Nancy Nord proposing to mitigate a few of the law's burdens through regulatory interpretation. Some critics of CPSIA saw reason for hope in this news.

After all, only days earlier, Waxman and Rush had dismissed the protests of craftspeople, thrift store owners and garment makers as the result of mere "confusion" and "inaccurate reporting." Had the two suddenly seen the light?
Alas for false hopes. Whatever its value as a political feint (don't blame us for what's coming!), the lawmakers' Jan. 16 letter does very little to avert the coming business calamity.
The letter proposes two specific new exemptions that are both arbitrary and narrow, and which make little sense except as a way to placate a few of the law's more visible and politically salient critics.
It is not clear that the CPSC, whose hands are tied by the law, in fact has legal authority to adopt even these modest exemptions--and in no case can it put them into practical effect before the looming deadline. What is significant is the ongoing bad news: Waxman and Rush remain dead set against the only real way forward, which is for Congress to revamp or repeal the law itself.
For those who came in late, a bit of background. As of Feb. 10, it will become unlawful to make or sell anything intended for use by children under 12 without a program to test the goods for lead--even if no items of their kind have ever been found to pose a lead risk, even if you make and sell only a few inexpensive items a year, even if you've sourced their materials from the most conscientious local suppliers and even if they're items toddlers seldom convey into their mouths, such as dartboards or bicycle tires.

If you are one of the many people who like something original or high quality not from the usual big brand retailer; please take note... our rights to make decisions as to what to purchase for our children is about to be taken away because of an ill thought out act. The CPSIA will come into effect Feb. 10th and will put standards on small business and WAHMS that will then have to shut their doors. Please help us get the message to congress that this is not ok and we the people will not accept their lack of planning and thought prior to signing it.

There’s currently a war going on between congress and CPSC which is causing INACTION.
Waxman and Rush created CPSIA and authorized CPSC to interpret it. After the very recent backlash from his constituents, Waxman responded by writing the letter to NORD (ATTACHED HERE) Please read it. It details the various recommendations that might save your business!
Still, CPSC (Nancy Nord and Thomas Moore) feel as if their hands are completely tied and are still not able to APPLY the recommendations without more direction/authority/money.
There are two things you can do and it is urgent you do them soon and frequently because meetings are taking place now and your input and action are necessary.
First, please contact Nancy Nord and Thomas Hill Moore of CPSC and let them know you are very much aware of the Waxman/Rush recommendations (Jan 16) that they’ve been asked to implement immediately . This sends the message loud and clear that they are now accountable. This message is so important because their response has been that they have no authority to change anything. Stress that their very commission ( CPSC ) has been given FULL Authority to make these necessary changes - it says so in this letter!! Ask what they are doing about this!? When will we see clarification and changes??!!! WHILE YOU’re AT IT, DEMAND THAT THEY ALLOW XRF LASER TESTING OR COMPONANT TESTING to qualify after August 2009!!!
I’ve provided phone/fax and email link. use ALL THREE!!! cut and paste parts of the waxman letter. if you’re really lazy, fax them the above letter and underline parts you want them to address.

The new CPSIA law affects so many thousands, possibly millions of small businesses. It's so sad that something meant to help children is going to have such a negative impact on small businesses, especially in these already difficult economic times. The website etsy.com features handmade items by individual sellers, and so many thousands are upset about this law, and trying to get it amended. The new law effects ANY product that is intended for use by a child under the age of 12. Toys, clothing, cloth diapers, blankets, hair bows, EVERYTHING! If the product is meant for adults, but "looks" like something a child would like, it is included! For those who don't know, the CPSIA (Consumer Product Safety Improvement Act of 2008) is an act designed to protect our children from unsafe toys, aka.. lead at excessive levels.. and thats a noble cause, HOWEVER, this act requires ANY item designed, marketed to, intended for use by, or looks like it could be designed FOR any child under the age of 12 must be tested. Sounds like a good idea, but you have to consider that the cost for these tests (estimates on different websites vary) have ranged from $100.00 to $4000.00. Even if we assume its $100.00, the average crafter cannot afford to have every "batch" of their craft tested. This act is poorly written and doesnt adress the REAL problem... it forces testing on products manufactured in the US, when our products werent the problem to begin with. We should be forcing testing on every product IMPORTED to the US, but a witch hunt on good American companies making good healthy products is not helping. In this economy, do we really need to put more of a burden on our businesses?
THIS AFFECTS EVERYONE! This affects at home care-takers, daycares, and schools... as your cribs and any toy items must be tested for lead. This affects crafters, of course. This affects Re-sellers, such as Salvation army and others, as THEIR apparel and toys must be tested. This affects GARAGE SALES. According to this act, you CANNOT sell any item for children under the age of 12 which has not been certified to meet the legal levels of lead. I am NOT joking, that is in the act. It is breaking the law to do so, and the fines are high.
Heres an example... if a bib maker makes 10 different styles of bib, with two fabrics on each bib, velcro, and heavy weight sew in.. she must have all10 of those bibs tested, at the $100 a pop (or more) and if she sews a different style, even using the same fabrics, THAT must be tested. EVERY time she makes a new batch, they must be tested.. even if they use the same supplies. She must also PERMANENTLY label her items with the batch number, so consumers can know when it was made and what batch it came from.If a dress maker who makes children's dresses sews 20 different dresses, in 3 sizes each, she must have ALL sizes of all 20 dresses tested, even if they are made of the same fabric. Thats 60 tests. And dont think this doesnt affect ADULT apparel makers too, because it does... how many of you have 12 year olds who wear "adult" clothing? Not all 12 year olds shop in the junior section.. so adult clothing manufacturers will have to take extra precaution to ensure their products are never marketed to anyone under the age of 12, it goes so far as to say they cannot APPEAL to children under the age of 12. The law STATES that.. how can a dress maker ensure their product doesnt appeal to a child under the age of 12?
Small businesses CANNOT absorb the costs of this, they will either close their doors or raise their prices.. or stop selling items for children under the age of 12. We all buy our products (materials) from retailers here in the US... surely if those products (materials) were tested that would be good enough, right? No. The finished product must be tested, regardless of the materials being safe.
Here are some TRUE-VRS-FALSE things we managed to find, in regards to this Act, and how it will affect CRAFTERS specifically, of any item for children under the age of 12. Do your own research and read the law.. and of course, all of this is subject to change because there are amendments to this Act, and there are people fighting to change it. This isnt the "final word" this is a.. right now we think.. kind of deal.
Statement - certain things will be exempt for testing, like apparel, because fabric doesnt have lead in it.FALSE- all items marketed to, designed for, advertised as, or for use by a child under the age of 12 must be tested for lead, even if it does not contain any.In 180 days, must test less than 600 parts per million. In 365 days, must test less than 300 parts per million. in 3 years from date of enactment, must test less than 100 parts per million. WHAT the item is does not matter. It MUST test if it is to be used by a child under the age of 12.
Statement - on Feb 10th the store shelves will be empty, everything not tested must be disposed of.UNDETERMINED-I am getting conflicting information. I cant say yes or no on this, to be honest I dont trust anyones "opinion" on this, including mine. I have contacted my states governer, and my senator. Both of their "offices" have replied that my concerns will be adressed. I dont know how long that will take.

From what I read.. I gathered that all items are subject to an up to 10 month grace period for testing.. you have to have certificates for every item to prove you had them tested. BUT, I could have read it wrong. Statement - All cribs must be tested if they are to be used in a daycare, home care facility, or to be re-sold (such as a hand-me down store, or consignment shop)TRUE - unless amended (and it SHOULD be.) - It shall be a violation of section 19(a)(1) of the Consumer Product Safety Act for any person to which this applies to manufacture (make), sell (store or otherwise), contract to sell or resell (consignment store), lease, sublet, offer, provide for use (give away!!) or otherwise place in the stream of commerce a crib which is not in compliance with a standard promulgated under subsection (b). (meaning it must meet the lead levels I mentioned above... 600 parts per million, then 300.. maybe 100 eventually).
This applies to any person that -(a) MANUFACTURES, DISTRIBUTES, OR CONTRACTS TO SELL CRIBS; (Salvation army, Consignment stores, Goodwill, Garage sales, Deseret Industries, Baby stores, Walmart.. it affects ANYONE who wants to SELL a crib.)(B) BASED ON THE PERSON OCCUPATION, HOLDS ITSELF OUT AS HAVING KNOWLEDGE OR SKILL PECULIAT TO CRIBS, INCLUDING CHILD CARE FACILITIES AND FAMILY CARE HOMES; (Daycares, at home care facilities, babysitters, ANYONE who has children in their home and receive pay for it.)(C) IS IN THE BUSINESS OF CONTRACTING TO SELL OR RESELL, LEASE, SUBLET, OR OTHERWISE PLACE CRIBS IN THE STREAM OF COMMERCE; OR (Consignment, Salvation army, Crib retailers, Baby Boutiques)(D) OWNS OR OPERATES A PLACE OF PUBLIC ACCOMODATION AFFECTING COMMERCE (HOTELS)
BASICALLY - THIS AFFECTS ALL OF YOU! According to the way this law is written, it could be ILLEGALfor your sister to give you her crib without having it tested. It could be illegal to sell a crib which has not been tested, even illegal to give it away. Cribs should be tested, but there should be an exemption or "grandfather" clause for ones already in circulation! I cant afford to have my kids crib tested so I can donate it after she doesnt need it anymore.. I KNOW Goodwill cant afford to have all kids cribs tested before they can sell or donate them. This is REDICULOUS.
All "Durable infant or toddler products" must be tested... those are defined as:(A) Full size cribs and non full-size cribs; (B) toddler beds; (C) high chairs, booster chairs, and hook-on chairs; (D) bath seats; (E) gates and other enclosures for confining a child; (F) play yards; (G) stationary activity centers; (H) infant carriers; (I) strollers; (J) walkers; (K) swings; and (L) bassinets and cradles. ALL of those items are included in the law I posted above, ALL are illegal to sell or give away, even by you, without a lead test certification.
If you planned to donate your childrens old items, you cant. If you planned to give them to a friend, you cant. If you planned to sell them, you definitely cant. According to this law, as it is written right now, you CANT. its ILLEGAL. (to find out what you can do, keep reading)
1) DEFINED TERMS- As used in this section
(A) The term `phthalate alternative' means any common substitute to a phthalate, alternative material to a phthalate, or alternative plasticizers(B) The term `children's toy' means a consumer product designed or intended by the manufacturer for a child 12 years of age or younger for use by the child when the child plays(C) The term `child care article' means a consumer product designed or intended by the manufacturer to facilitate sleep or the feeding of children age 3 and younger, or to help such children with sucking or teething. (PAJAMAS, BEDDING, BLANKETS, BIBS, PACIFIERS, TEETHERS, BOWLS, SPOONS, FORKS, CUPS, HIGHCHAIRS, ANYTHING TO HELP A CHILD SLEEP, EAT, SUCK, OR TEETH)(D) The term `consumer product' has the meaning given such term in section 3(a)(1) of the Consumer Product Safety Act (15 U.S.C. 2052(a)(1)).(A) AGE- In determining whether products described in paragraph (1) are designed or intended for use by a child of the ages specified, the following factors shall be considered:(i) A statement by a manufacturer about the intended use of such product, including a label on such product if such statement is reasonable.(ii) Whether the product is represented in its packaging, display, promotion, or advertising as appropriate for use by children of the ages specified.(iii) Whether the product is commonly recognized by consumers as being intended for use by a child of the ages specified.(iv) The Age Determination guidelines issued by the Commission staff in September 2002 and any successor to such guidelines.(B) TOY THAT CAN BE PLACED IN A CHILD'S MOUTH- For purposes of this section a toy can be placed in a child's mouth if any part of the toy can actually be brought to the mouth and kept in the mouth by a child so that it can be sucked and chewed. If the children's product can only be licked, it is not regarded as able to be placed in the mouth. If a toy or part of a toy in one dimension is smaller than 5 centimeters, it can be placed in the mouth.
Statement - well how will they know we are not complying? They wont worry about us, we're small potatoes.TRUTH -Maybe, maybe not. Is it a risk you are willing to take? I listed the fines below. Just be aware, in the UK they have had tougher toy laws for a long time.. as a result, their toys are safer.. but also as a result, crafters are subject to having their product confiscated, even at craft shows, if they do not comply with the law and regulations. YES, they can find you. Will they? Maybe not.. but I am not willing to risk a $100,000 fine to find out.
(1) CONSUMER PRODUCT SAFETY ACT- Section 20(a)(1) (15 U.S.C. 2069(a)(1)) is amended--
(A) by striking `$5,000' and inserting `$100,000';
(B) by striking `$1,250,000' both places it appears and inserting `$15,000,000'; and
(C) by striking `December 1, 1994,' in paragraph (3)(B) and inserting `December 1, 2011,'.
(they took the fine from $5000, and made it $100,000?!!?!?!!)
